Fish Passage and Instream Structures 

The National Environmental Standards for Freshwater 2020 (NES-F), includes rules for structures that affect fish passage. If you’re installing a new structure in a river, you must provide specific information to the Council.

Why Fish Passage Matters 

Many fish species in Tasman, such as whitebait and eels, migrate as part of their lifecycle. Instream structures like culverts, weirs, and dams can block or delay these movements, preventing fish from reaching critical habitats and completing their natural lifecycle.

New Regulations

The National Environmental Standards for Freshwater 2020 (NES-F) (see sections 58-78) introduced National Rules for fish passage.

Key points:

  • Instream structures must meet minimum environmental standards for fish passage.
  • Some structures may require resource consent.
  • Rules apply to all instream structures (culverts, weirs, flap gates, fords, dams), whether temporary or permanent, installed after 3 September 2020.
  • These national rules are in addition to regional rules in  Part 4: Rivers & Lakes of the Tasman Resource Management Plan (TRMP),  which must also be considered.
